CAYMAN ISLANDS TO DISCLOSE HIDDEN COMPANIES AND DIRECTORS

Class Warfare Exists

The Cayman Islands has been just one of a handful of countries which are primarily used for tax evasion by exploiting the tax code and the protections of foreign governments.  As a British territory – their laws are very much under the influence of what Britain does and doesn’t want.  Which makes it all the more interesting that the Cayman Islands monetary authority is now going to be disclosing a laundry list of previously hidden corporations and hedge funds using the Caymans for cover from transparency.  In addition – the names of those involved will be visible for the first time as well which will make it that much easier for Western governments to identify tax schemes.  This is an assault on tax cheats – mainly corporations and wealthy individuals.

The Caymans Islands is just the latest country to submit to banking transparency in a very long recent list.

The British overseas territory, which wants to shed its reputation for clandestine financial activity, is introducing sweeping reforms that will make public the names of thousands of previously hidden companies and their directors.

In proposals sent to Cayman-based hedge fund businesses and seen by the Financial Times, the islands’ powerful monetary authority, CIMA, has outlined plans to create a public database of funds domiciled on the island for the first time. The database will also list funds’ directors, pending an ongoing consultation process due to close in mid-March.

CIMA, which did not respond to a request for comment, also plans to require directors to undergo a vetting process to ensure they are qualified to act as fiduciaries for investors.

Since President Obama was sworn into office – the American government has actively pursued breaking tax havens.  Many banks in Switzerland won’t take American clients because of the pressure being exerted on the Switzerland government and the mini banking cartel that exists in Zurich (source).  For the first time in modern history – Switzerland is actively disclosing personal banking information to the American authorities (source).  This can only be the result of leverage which the Obama administration is exerting to its fullest.

The Obama administration entered into a treaty with Ireland – another tax haven – to share financial information in December of 2012 (source); it’s notable that this happened after Obama won re-election.  The Obama administration has negotiated treaties with Hungary, Switzerland and Luxembourg for open and transparent disclosure between governments to catch tax cheats – all three of these countries are used as tax havens.  Currently – these treaties are being held up by Rand Paul in the Senate (source).  In short – the Obama administration has been on a worldwide mission to destroy tax shelters that the wealthy use to avoid paying their taxes.

The decision to make the Caymans more transparent is either the result of the LIBOR scandal or the American government requesting changes from the Brits.  The British is one of America’s closest allies and I suspect they would be willing to entertain concerns shared by the Obama administration.  We really don’t know why the British pushed this through.

The Offenders

If they’re a multi-national corporation or a hedge fund – they’re probably abusing tax law by using offshore tax havens.  U.S. corporations have anywhere from $1.4 to $2 trillion in cash just sitting in offshore banks right now (source).  They have gamed the system and the only way they can bring the money back is if they pay a higher tax rate.  They’re putting tremendous pressure on politicians to give a “one time tax holiday” just like the “one time tax holiday” the Bush administration allowed for in 2004.  That would be a disaster and would reward tax evasion.

Microsoft avoided paying $7 billion in taxes from 2009 to 2012 according to a Senate committee HERE.

CNBC highlights how Halliburton has been able to do this HERE:

U.S. law does ban virtually all commerce with the rogue nations, but there’s a loophole that G.E., Conoco-Phillips and Halliburton have exploited: The law does not apply to any foreign or offshore subsidiary so long as it is run by non-Americans.

“These three companies, as far as we were concerned, appear to have violated the spirit of the law,” says Thompson. “In the case of Halliburton, as an example, they have an offshore subsidiary in the Cayman Islands. That subsidiary is doing business with Iran.”

That subsidiary, Halliburton Products and Services, Ltd., is wholly owned by the U.S.-based Halliburton and is registered in a building in the capital of the Cayman Islands – a building owned by the local Calidonian Bank. Halliburton and other companies set up in this Caribbean Island, because of tax and secrecy laws that are corporate friendly.

Google has used the Cayman Islands and other offshore tax havens to manipulate the tax code.  In 2010 – they paid 2.4% on $60 billion in revenues.  Bloomberg wrote a must read HERE.

Facebook paid just .3% on its profits in 2011 thanks to utilizing offshore tax havens like the CaymansHERE.

Americans became much  more aware of the loopholes used by the ultra wealthy during the 2012 election precisely because of Mitt Romney’s history of manipulating the tax code.  We’ve written about that many times but there is this one from the NY Times that makes it clear tax avoidance using offshore tax havens like the Caymans is just how they do business (source).

The Senate Banking Committee put out an excellent memo highlighting how these corporations and ultra wealthy are manipulating the tax code via offshore tax havens HERE; drug cartels and terrorist organizations use the same methods too btw.

Mediaite Launches ‘Trump Watch’ To Hold Cable Networks Accountable For Trump Airtime

This sounds like a good idea.  I’m not necessarily a Mediaite fan, but I do give them credit for conceiving this idea.  Donald Trump and his birther nonsense needs to be addressed by cable news outlets and call him out on his incessant lies.   They also need to reduce the air-time they have given him these past few days.

On the heels of Tuesday’s fiery Donald Trump birther showdown with CNN’s Wolf Blitzer, we here at Mediaite would like to finally hold his enablers accountable (and, of course, then in some meta way, we would continue to be enabling the enablers). It’s time for the cable networks to stop giving Donald Trump airtime.

Your willingness to give him airtime is precisely why Trump continues to make outlandish statements on every network within phone’s reach. We understand that he is in the news because of the Romney campaign, but even the sharks are complaining that they are tired of being jumped.

The usually-stoic Wolf Blitzer did a fine job of flogging Trump, making it clear that his birtherism is tiresome nonsense. But the mere fact that Blitzer had Trump on the air, despite Trump having no credibility, is maddening even to those of us who report on the reporters.

And so starting today — the first day of what most assuredly looks to be Trump Week — we here at Mediaite begin our official Trump Watch™. Each day, we will take note of how many times each cable network gives Trump the fumes of airtime that serve as his sustenance.

Today’s tally seems relatively small — CNN and CNBC are, so far, the only guilty parties. Trump is also slated to appear tonight on Greta Van Susteren‘s Fox News program. And we have no doubt that in the coming days, many others will cash in their Trump minutes. And we will be there to count the chips.

We will also track how often each network simply mentions Trump. According to TVEyes, on Tuesday, cable news outlets mentioned Trump for a combined 150 times. More than half of those came from MSNBC alone. And the day isn’t even over!

Rick Perry: Obama Birth Certificate ‘A Good Issue To Keep Alive’

Oh my goodness, Rick Perry is seriously going to tout the birther meme.  I thought he was just flirting with the idea, but it looks like he might launch a full frontal assault – with Donald Trump‘s help.

He honestly believes that keeping the birther issue alive will help catapult him back to the top of the polls.  It actually will, with the farthest right fringe in America, but not with the people who count the most…independent voters.

Texas Gov. Rick Perry said the birther issue was worth “keeping alive” in a CNBC interview Tuesday morning. “It’s a good issue to keep alive. It’s fun to poke at him,” said Perry, according to host John Harwood. Harwood interviewed Perry about his flat tax proposal that he is unveiling Tuesday, which sets an across-the-board twenty percent rate on individuals and corporations with some deductions.

Perry also spoke evasively about President Barack Obama’s birth certificate in an interview with Parademagazine published over the weekend. When asked if he believed the president was born in the United States, he said, “I have no reason to think otherwise.” Asked why he didn’t give a definitive answer, Perry replied, “Well, I don’t have a definitive answer, because he’s never seen my birth certificate.”

Perry said in the CNBC interview, “I’m really not worried about the president’s birth certificate. It’s fun to poke at him a little bit and say, how ’bout let’s see your grades and your birth certificate.” Perry’s own transcript from Texas A&M University, obtained by The Huffington Post, shows that he seldom earned anything above a C and includes a D in Shakespeare and a C in gym.

Despite the president releasing his long-form birth certificate online showing he was born in Honolulu, Hawaii, some still doubt that Obama was born in the United States, and therefore eligible serve as commander-in-chief.

When asked by Parade if he’d seen the president’s birth certificate, Perry said: “I don’t know. Have I?”

Goldman Sachs Employees Told To Stay Away From Occupy Wall Street: Report

Goldman Sachs has told its employees not to enter Zucotti Park, as the Occupy Wall Street protests continue, CNBC reports.

This is outrageous, yet totally expected from the likes of Goldman Sachs

Goldman Sachs employees better not think of grabbing lunch or taking in the scenery at Zucotti Park. “The firm” as it’s known among its workers hasbanned employees from going to the site of the Occupy Wall Street protests for any reason, CNBC reports.

As the protests, which started September 17 continue into their fourth week, Goldman Sachs employees are being told to stay away from the park, at least six Goldman staffers told CNBC. The staffers said they didn’t know whether the policy was official.

The ban on entering the the park is just one of many policies Goldman uses to try to keep its employees — and itself — out of the public eye. As of January, the investment bank had banned the use of Facebook, despite its $450 million investment in the social networking site, according to Fast Company. Goldman also banned its employees from commenting on popular Wall Street site Dealbreakerin 2008.

Right-wing attacks on President Obama are vicious, but the ugliness began with President Clinton

Alex Pareene captured the craziness of conservatives and business leaders who demonize President Obama, the man most progressives, whether they like it or not, recognize as the conciliator in chief. Home Depot chairman Ken Langone is just the latest to become unhinged on the topic of Obama, blasting him on CNBC recently:

“He is not acting presidential. He is behaving in a way designed in my opinion to divide us, to make us look at each other with skepticism, with suspicion. That is the end of America as we know it,” Langone fulminated. “The destruction he is inflicting by his behavior will carry on long after we settle the debt limit.”

I don’t know who Langone is describing, but it’s not Obama. Sure, he’s taken a jab or two at fat cats, and quickly retreated. Mostly he’s reached out to Republicans time and again, only to be rebuffed and humiliated, from the earliest days of his term. On “Hardball” today we discussed the extreme reaction this conciliating president has triggered in the GOP, from the earliest moments of his presidency.

Appearing on CNBC this morning, presidential candidate Rep. Michele Bachmann (R-MN) was asked about this morning’s dismal jobs report and whether higher unemployment rates might help her chances of winning in 2012. “Does it strike you that as the unemployment rate goes up, your chances of winning office also go up?” host Carl Quintanilla asked. “Well, that could be. Again, I hope so,” Bachmann replied.

While it’s of course acceptable for Bachmann to campaign on wanting to turn the economy around, it’s another matter entirely when she actively pursues policies that make the economy worse — while hoping it will help her campaign.

Jon Stewart didn’t just go for the gags.

While joshing around with Barack Obama last night on a set festooned with faux Roman columns, Stewart spoke as the voice of disenchanted liberalism, demanding to know: What happened to that hope-and-change guy?

“You ran with such, if I may, audacity… yet legislatively it has felt timid at times,” the host said. “I am not even sure at times what you want out of a health care bill.”

The guest, buoyed by an adoring audience, pushed back: “Jon, I love your show”—here Stewart mugged for the camera—”but this is something where I have a profound disagreement with you…This notion that health care was timid—you’ve got 30 million people that will have health insurance because of this.”

That the president of the United States would appear on the Daily Show six days before a midterm election that could sink his party speaks volumes, or at least chapters, about that buzzworthy forum. But it was also a test of sorts for the host, who is casting his big “sanity” rally in Washington as an escape from the nuttiness fostered by the extremes of both parties.

Can Saturday’s extravaganza live up to its nonpartisan billing if its ringmaster is seen as too friendly with the Democrat-in-chief? I’d say Stewart passed the initial exam, making Obama feel comfortable while also delivering the zinger that “Democrats this year seem to be running on ‘please baby one more chance.’”

Stewart told me years ago that he regarded the nightly interview segment as little more than filler that spared his staff from having to write one more comedy sketch. But it’s evolved into an key component of the program, as anyone who saw his combative sessions with CNBC’s Jim Cramer or health care critic Betsy McCaughey can attest (though Stewart conceded that Bush torture defender John Yoo “slipped through my fingers”).

Middle Class American To Obama: I’m Exhausted Defending You (Video)

In a town hall discussion broadcast live on CNBC Monday, President Barack Obama said the country’s economy is “moving in the right direction” — even if it doesn’t feel that way. 

Responding to questions from, in addition to the host John Harwood, a student, a Wall Streeter, a small business-owner and a self-described member of the middle class, the president acknowledged that “times are tough for everybody,” but pointed to his record so far as president and asked the audience to trust in his agenda. “We went through the worst recession since the Great Depression,” he said. “Those programs that we put in place worked. So now you’ve got a financial system that is stable. …The challenge is that the hole was so deep.” 

The tough questions came near the beginning. The chief financial officer for a veterans service organization, who called herself a “middle-class American,” said she was “exhausted of defending you” and “deeply disappointed with where we are right now.”
